These terms set forth the terms and conditions under which you may use our website and services as offered by us. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these terms.

SOCIAL MEDIA, WEBSITE & PROMOTIONAL CLIENT PHOTOS

Client before/after photos are often taken for the use of advertisement. If you are paying full price you are able to opt out of these photos by verbally letting us know. If you are receiving treatments at a discounted rate, part of the terms of you booking is that you agree to promotional photographs being taken, used and stored at Earth & Beauty's discretion. The reason for promotions is to generate more photographic material for advertisement purposes. In some cases. photos may be required just for our own records.

PATCH TESTS

Most of our services require clients to have a patch test carried out a minimum of 24-48 hours before the treatment time. This is to ensure that any allergic reactions to the product can be ruled out ahead of the treatment. Clients who have not booked in for a patch test when required, may be refused treatment on the day and be subjected to charges outlined in the cancellation and amendment policy.

PAYMENT OPTIONS

Payment options online are Paypal, debit or credit card, or one of our partnered payment plan providers. If there is a 50% balance due on the day the session is redeemed the payment options are; cash, card, contactless, ApplePay, Googlepay.

BRINGING CHILDREN

The salon environment is not suitable for bringing young children along. Please do not bring anyone under secondary school age. 

 

BRINGING A FRIEND

The salon has a small waiting area suitable for clients waiting a few minutes for their appointment, or for a parent waiting for their teenager to have their treatment. We strongly advise that friends and family members do not accompany you to your appointments, unless there are special circumstances, in this case Earth & Beauty may or may not make an exception at its own discretion.

NON-REFUNDABLE DEPOSIT

• Sessions valued under £50.00 will have a non-refundable booking fee of 50%.

• Sessions valued over £50.00 will require a prepayment of 100% of the service value which is subjected to a 50% non-refundable booking fee.

• The 50% prepayment of any services is non-refundable regardless of service redemption, attendance, amendment or cancellation.

CONSULTATIONS & PATCH TESTS

​

• All sessions that fall into the category of 'Consultation' are payable in full in advance, even though they are valued under £50.00.

• The whole amount is non-refundable. 

• Sessions can still be amended with a minimum of 48 hours notice via the online client portal with no charge.

• Amendments or cancellations within 48 hours will mean the client will lose the amount paid.

 

CANCELLING WITHOUT RESCHEDULING

• If the session is valued under £50.00, in this instance the client will lose the non-refundable booking fee.

• If the session is valued over £50.00 and the client does not wish to reschedule then Earth & Beauty will refund the remaining 50% once this has been requested via WhatsApp or SMS +447811181101.

 

RESCHEDULING WITH MORE THAN 48 HOURS TO THE SESSION START TIME

• All clients can amend their appointments for free via the client portal with up to 48 hours before the session begins.

• Make sure to amend your current booking instead of cancelling it and rebooking another, as your prepayment is attached to your current booking and the system does not automatically refund you if you cancel and rebook.

SESSIONS VALUED UNDER £50.00 AMENDING WITH LESS THAN 48 HOURS TO THE SESSION START TIME

• Clients who wish to amend their session with less than 48 hours of it beginning will lose their non-refundable booking fee.

• Clients should give as much notice as possible via +447811181101.

• Clients will have to make a new booking via the booking system.

• Repeat offenders (more than three times) will be blacklisted regardless of the non-refundable fee retained by Earth & Beauty.

SESSIONS OR COURSES OF SESSIONS VALUED OVER £50.00 IN TOTAL AMENDING WITH LESS THAN 48 HOURS TO THE SESSION START TIME:

• For clients who wish to amend their session with less than 48 hours of it beginning there will be a charge applicable before the appointment can be rescheduled or redeemed.

• You will need to contact +447811181101 via WhatsApp or SMS to reschedule the appointment. 

• You will be sent a secure Sumup link to pay the charge, based on how many minutes was booked out of Earth & Beauty's calendar at a rate of 50p per minute.

ALL SESSIONS

• This policy applies to all sessions including; new sessions, follow-ups, top-ups and consultations, and sessions booked as part of a course.

​

NO EXCEPTIONS

• Clients are responsible for attending their appointments on time. 

• Unforeseen circumstances, or clients' personal misfortune are not something Earth & Beauty can lose income for.

​

Charges will be applicable for the following circumstances:

• Illness of client/family member

• Childcare issues

• Transport issues

• No-shows

• Client forgetting the appointment

• Lateness

• Client did not book in for and receive the relevant patch testing or consultation appointment and booked an appointment regardless, resulting in time being booked out of the working-calendar which could have been income-producing time with another client. (E.g. A client books 30 minutes for a Brow Thread & Tint, but has not had a patch test, they are only able to receive the threading on the day which takes 15 minutes. In this case, the client will still be charged for the full price of the Thread & Tint but not be able to receive the full service on that day. An additional charge will be applicable to receive the tint part of the treatment on a later date, once the patch test has been carried out.)

• Any other situation that Earth & Beauty does not deem to be an extreme situation.

IF EARTH & BEAUTY  CANCELS

If Earth & Beauty is unable to keep your booking time due to unforeseen circumstances, in this rare case, you will be contacted with as much notice as possible to reschedule. You will not be required to pay for the same treatment twice in this case, and if you are unable to make any other time then you will be offered a full refund (if you have paid in advance).

FOOD & BEVERAGES

Clients should not bring any food items to the treatment room, and the same goes for any beverages that have lids that cannot be 100% fastened. Takeaway coffee cups and hot beverages in general are not permitted in the salon at any time.

​

SICKNESS

Clients experiencing any symptoms of any infectious condition must not attend the salon until 14 days after all symptoms have passed. Those displaying any cough, cold, flu or sickness bug symptoms at their appointment will not be seen and will be charged a fee for the time-slot regardless.

​

HEALTH PRECAUTIONS

Clients who work in the healthcare sector are politely and respectfully asked to not wear their uniform to the treatment room, even if coming straight from work (please change into personal clothing before arriving at your appointment if this is the case).

​

On arrival, clients have the chance to wash and sanitise their hands and will also be able to do this at the end of their appointment before leaving.

​

DISCOUNT CODES

Clients who are using a discount code must ensure that the discount code is indeed applied at checkout otherwise the discount will not be valid.

FURTHER T&C's

In order to use our website and/or receive our services, you must be at least 16 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you. If you are under aged 16, you may receive certain treatments with our parental consent form being signed.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Earth & Beauty. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

You agree to indemnify and hold Earth & Beauty harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, in no event shall Earth & Beauty, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Earth & Beauty assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United Kingdom, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the UK. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
